If the matter isn’t resolved after raising a grievance, you can take your employer to a tribunal.

To do so, you’ll need to inform ACAS (The Advisory, Conciliation and Arbitration Service) and they’ll contact your employer to see if they’re willing to agree to early conciliation. That is essentially a settlement without needing to go through the formal process of an employment tribunal.

However, if you can’t come to an agreement then you can still take your employer to a tribunal. This is usually seen as a last resort due to the time and stress involved in tribunal cases and the fact that it can be expensive.

The deadline for applying to the tribunal is 3 months (minus one day) from when you should have been paid. After this date, it’s incredibly difficult to obtain any missed payments from your employer.
